John Malarney sustained serious injuries to his right shoulder, neck and back following a collision with a pickup truck. The insurance company initially offered $80,000 to settle the case but paid over 10 times more after a successful mediation, resulting in the $840,000 settlement.

Accident Victim Suffers Serious Injuries

Waterbury staff members Back in 2016, Richard Crane drove his pickup truck through a stop sign, colliding with John Malarney’s minivan. Crane was issued an infraction for the incident; meanwhile Malarney suffered injuries that still affect his life today. The crash totaled our client’s vehicle and has accumulated nearly $130,000 in medical expenses thus far. Attorney Ron Etemi filed suit in Litchfield Superior Court on Malarney’s behalf in May 2017.

In mid-2018, Malarney had right shoulder surgery and “is still dealing with pain that can hamper his day-to-day activities,” Etemi said. “He gets occasional pain injections in the neck, shoulder and back, but John is a very strong man. He does his best, considering the injuries he has.”

The defense argued our client was responsible for his own injuries, having failed to apply his brakes to avoid the collision, but the police did not cite Malarney. Our client “was happy with the settlement,” Attorney Etemi said.
