    Understanding the Difference Between E-Bikes, Mopeds, and E-Scooters

    New York law has different requirements for different types of two-wheeled electric vehicles. Per NY VAT § 144-E, an e-scooter:

    • Weighs under 100 pounds.
    • Is equipped with handlebars, a floorboard or seat, and electric power.
    • Can be powered by both electric and human power.
    • Has a maximum speed of 20 miles per hour on a paved level surface when powered only by the electric motor.

    Under NY VAT § 1284, e-scooters can ride in both vehicle lanes and bike lanes, but they must keep to the right side and shoulder of vehicle lanes. They are not permitted to operate in vehicle lanes on roads with speed limits over 30 miles per hour, per NY VAT § 1282. However, the law also allows specific municipalities to limit access for electric scooters.

    Suffolk County prohibits e-scooter operation on sidewalks, roadways, highways, parking areas, and other public spaces, per Suffolk County Code Article II § 319-11. Nassau County, on the other hand, allows e-bikes and scooters to operate consistent with New York State law, though local towns and villages may impose additional restrictions.
