Our Attorneys Will Fight for Full and Fair Compensation

Your family has been through enough; you should not have to deal with added worries about how you will pay for your loved one’s fatal accident. Our Waterbury lawyers will seek full and fair compensation for injury-related expenses. In general, damages may include:

    • Medical treatment – We will seek compensation for medical bills resulting from your loved one’s injury, including the cost of emergency transportation, emergency services, hospital stays, doctor visits, surgeries, prescription drugs, medical equipment, extended nursing, and palliative care.
    • Lost income – We will pursue your loved one’s lost wages and employment benefits from the time of their injury until their passing. We can also seek compensation for the income your loved one would have earned had they survived.
    • Funeral and burial expenses – Funeral and burial expenses can be significant and unexpected. We will seek to recover these costs.
    • Pain and suffering – We will seek damages for conscious physical pain and suffering, mental anguish, and emotional distress experienced by your loved one before their passing.
    • Loss of consortium – We will help the deceased’s surviving spouse pursue a loss of consortium claim as part of a larger wrongful death claim. Loss of consortium provides monetary compensation for the intangible benefits of marriage, such as comfort, companionship, and society, as well as for services the deceased would have provided.

How We Build Your Wrongful Death Case to Seek Compensation

We do the work needed to build a solid case so you can focus on grieving your loved one and getting your life back on track. We will do the following to get justice for your family:

    • Investigate – Our team will investigate your loved one’s accident and collect evidence. We will use the proof we gather to identify at-fault parties, prove they acted negligently, and establish your right to recover compensation. Evidence in a fatal injury claim may include expert and eyewitness testimony, photographs and video from the accident scene, police reports, medical records, and proof of losses, such as bills, receipts, and wage reports.
    • Negotiate – We are skilled negotiators and will not back down. We will tirelessly represent your best interests and protect you from bad-faith tactics, undue pressure, and lowball offers. We will handle all of your case-related communications and will not settle for less.
    • Litigate – We have extensive trial experience and will not hesitate to pursue damages in civil court when necessary.

Throughout the legal process, we will manage case details, like paperwork and deadlines. You can expect constant communication from our team, including frequent and timely updates.

How to File a Wrongful Death Lawsuit in Connecticut

In Connecticut, a victim’s family member cannot file a wrongful death lawsuit. Instead, the administrator of the deceased’s estate (the executor) must file a case on behalf of the estate. Recovered compensation is distributed to the deceased’s beneficiaries according to the deceased’s will. If there is no will, damages are dispersed according to Connecticut’s estate laws.

There is also a limit on how long the executor has to file. According to CT Gen. Stat. § 52-555, the statute of limitations for wrongful death is generally two years. If time runs out, the court will likely refuse the suit.
