What is Social Security Disability (SSD)?
Social Security Disability benefits are awarded to workers who, because of physical,
mental, or both conditions can no longer perform the work for which they are, or have
been in the past, employed.
What does the SSD evaluator look for when reviewing a case?
The case reviewer is looking for sufficient, recent medical evidence that supports the
claim that you are not capable of working at the current or previous types of jobs you
have held, and that this incapacity has lasted, or will last for a period of twelve months
or more.
Do I need a lawyer to file for Social Security Disability?
No, initiating the claim is straightforward and can be done over the phone, at a
Social Security field office, or online. You do not need a lawyer to complete this
process. Nearly 40% of first-time claims are approved.
Download the
Social Security Disability Starter Kit. This kit, prepared by
the government, gives you the step-by-step information you need to prepare your claim.
Or, you can call your local Social Security office to apply over the phone, or make an
appointment to apply in person
What do I do if my claim is denied?
If your claim is denied – and they are over 60% of the time – an experienced
Social Security Disability lawyer is very helpful in preparing
you for the reconsideration and/or appeal process.
Our attorneys have the knowledge and experience to prepare and defend your case according to the laws.
You have 60 days from the date of denial to file a Request for Reconsideration, or a
Request for Hearing, but you should contact us as soon as possible
When is the final decision made?
It can take from three months to more than a year to get a final decision. It all depends on how well prepared
your case is, and how many denials you receive (if any).
How much does it cost?
If you are denied, you pay nothing. If you are awarded Social Security Disability benefits,
the fee is set by law as 25% of the amount of money you receive in back benefits,
not exceed $6,000. If there are any expenses associated with filing your claim,
you will be made aware of them ahead of time.
